Obtaining a court judgment or holding an enforcement instrument doesn't mean automatically recovering your money or right; the actual step turning paper into tangible reality goes through the competent Enforcement Court. The Enforcement Law issued by Royal Decree M/53 sets out in its Article 9 the accepted types of enforcement instruments: court judgments at all levels, commercial paper (cheques and promissory notes), arbitral awards, and notarized contracts such as unified "Ejar" lease contracts.
After registering an enforcement request, the enforcement judge issues Decision 34, notifying the debtor and granting them five days to pay or clarify. If they don't comply within this period, stricter measures follow (Decision 46) potentially including a travel ban of up to three years, freezing bank accounts and real estate, and questioning the debtor, their accountant, and employees to trace their assets. If refusal continues despite ability to pay, the debtor may be held in enforcement detention by order of the enforcement judge.
Cheques and promissory notes carry inherent enforceable force once their formal conditions are met, allowing the holder to go directly to the Enforcement Court without needing to first file a full substantive lawsuit: a much faster route to recovering amounts due.
The law takes care to protect a minimum standard of living for the debtor and their family, exempting from forced enforcement the debtor and family's residence (under specific conditions) and necessary personal items and furniture. The debtor also has the right to file an insolvency claim before the Enforcement Court, along with the obligation to provide a full detailed statement of their money and property and prove their inability to pay.
