The new Government Tenders and Procurement Law grants every bidder the right to object to any decision the government body makes before the award decision within just five working days of the decision, and an additional right to object to the award decision itself during the "standstill period" (5 to 10 working days after announcing the winner). The grievance begins before the government body itself, which must decide on it within 15 working days (otherwise deemed an implicit rejection). If rejected or the period lapses without response, the objector may, within three additional days, escalate to the Committee for Reviewing Bidders' and Contractors' Grievances, a specialized committee issuing decisions binding on the government body, provided a guarantee of 0.5% of the bid value is submitted (refunded if the grievance is upheld).
Failing to submit the required bank guarantee, submitting it in the name of a body other than the competent committee, or missing the deadline by even one day are all sufficient grounds to reject the grievance formally without reviewing its merits. Procedural precision in these cases matters as much as the strength of the argument itself.
