When a dispute reaches the point of needing judicial intervention, choosing the right track from the start saves significant time and cost: litigation and advocacy before the general courts, or commercial arbitration as a faster, more private route for certain disputes, alongside mediation, judgment enforcement, and cross-border international disputes.
If your contract includes an arbitration clause, going straight to court can be met with a defense arguing the court lacks jurisdiction, sending you back to square one after months of wasted time. The reverse is also true: arbitrating a low-value dispute can cost more than the dispute itself in arbitrator fees. Choosing the right track needs a careful reading of both the contract's wording and the nature of the dispute, not a general assumption that one track is always "better."
Every stage of litigation, from filing the initial claim to appealing a judgment, is governed by strict statutory deadlines; missing an appeal deadline doesn't just mean losing that round, it can mean permanently losing the right to appeal regardless of how strong your substantive arguments are. Many cases that reach us too late need us searching for any remaining procedural way out rather than a substantive review, a far narrower path than acting at the right time would have been.
Winning a judgment doesn't automatically mean collecting what you're owed; the enforcement stage before the Enforcement Court has its own independent procedures, and the judgment debtor may resort to various delay tactics that require an entirely different legal approach from the original litigation. Rights holders who stop paying attention once judgment is issued, without following through on actual enforcement, may wait months or years without collecting.
When one party to a dispute is outside the Kingdom, conflict-of-laws rules and international conventions enter the picture, and determining which court or arbitral body even has jurisdiction becomes a dispute in itself, before the substance of the case is even discussed.
Every dispute has its own circumstances that determine the right track; browse the page that matches your specific dispute below, or message us directly on WhatsApp for an assessment.
