Guardianship (wilaya) is automatically established for the father over his minor children by operation of law without needing a constitutive court decision, while custodianship (wisaya) is authority the father explicitly grants (to a person he chooses for when he's incapacitated or after his death) or the court grants absent a qualified legal guardian. Article 137 of the Personal Status Law clearly defines this difference: the guardian is the father or whoever the court appoints; the custodian is whoever the father appoints for when he's incapacitated or after his death.
Guardianship over the person means general oversight of the minor's person without conflicting with the actual custodian's authority, while guardianship over property specifically concerns managing the minor's money and financial interests. Both types may combine in one person, but may also be separated when the minor's interest requires it (such as when the custodian isn't qualified to manage substantial funds).
The law requires full legal capacity, trustworthiness, genuine ability to fulfill the guardianship's requirements, and not having been convicted of a crime involving moral turpitude, or of insolvency, or removed from prior guardianship for causing harm. These requirements protect the minor from their custodianship being assigned to someone genuinely unqualified regardless of their degree of kinship.
Protecting the insane and mentally incapacitated, interdiction is established the moment the condition itself is confirmed, without depending on a constitutive court judgment; the court judgment in this case merely reveals and confirms the condition. Financial transactions by someone totally lacking capacity (insane) are absolutely void, while the effects on someone with diminished capacity vary by the degree of impairment.
